Processing and Constitution of Mining Concessions

Mining concessions are established by court orders and we take care of all the steps required by law to establish these concessions. We analyze with the Client the benefits of different types of concessions in their geographical area of interest.

Below we enlist some of the main characteristics of Exploration Concessions and Exploitation Concessions.

Exploration Concessions

Characteristics

  • A minimum area of 100 hectares and a maximum of 5,000 hectares.
  • Duration of 2 years after its constitution.
  • The holder has the right to perform the duties and tasks related to exploration and exploration pits.
  • Only the holder may exercise ownership (operation concession) during the life of the exploration concession.
  • The owner is not entitled to put on the market any minerals extracted from the concession area.

Process

  • The process begins with the submission of a legal writing called a Motion (Pedimento) before the appropriate judicial court.
  • Subsequently, the Motion is registered at the Mine Registrar (Conservador de Minas) and then is published on the Official Mining Bulletin (Boletín Oficial de Minería).
  • A tax or excise duty has to be paid.
  • Filing to the Court the constituent statement request prior to the payment of the patent proportional to the area requested.
  • An excerpt of the statement is registered at the Mine Registrar and published on the Official Mining Bulletin.
Exploitation Concessions

Characteristics

  • A minimum area of 1 hectare and a maximum area of 10 hectares.
  • They are of an indefinite duration as long as the corresponding patents are paid accordingly.
  • The holder has the exclusive right to explore and extract minerals from the concession area.
  • Perform measurements.
  • The holder is entitled to extract minerals from the concession area and put them in the market.

Process

  • The process begins with the submission of a legal writing called a Manifestation (Manifestación) before the appropriate judicial court.
  • Subsequently, the Manifestation is registered at the Mine Registrar (Conservador de Minas) and is published on the Official Mining Bulletin (Boletín Oficial de Minería).
  • A tax or excise duty has to be paid.
  • Submission of the application for onsite survey.
  • Proportional payment of the patent and its publication on the Official Mining Bulletin.
  • Onsite survey. Measurement of the materials in the earth (Tecnomin has their own team of Expert Surveyors).
  • Filing to the Court the constituent statement request for the concession, and its publication in the Official Mining Bulletin and registration at the Mine Registrar.
